Baltimore, MD – May 13, 2008 – The murder trial of Michael Martin, 28, of the 200 block of Allwood Road and Tracy Asbury, 37, of the 4800 block of Pennington Avenue is scheduled to begin 9:30AM tomorrow before Judge John A. Howard, 438 Mitchell Courthouse, 110 North Calvert Street.

The Baltimore City Grand Jury indicted Martin and Asbury July 16, 2007 on first degree murder and other counts.

Court documents allege Martin, Robert Speake and Asbury were responsible for an incident that occurred on June 20, 2007.  The body of Phillip Calvin Airey Jr. was found in a burning car on Route 295 in Linthicum that day.  Airey had been beaten and stabbed before the car was set on fire.

Speake, 19, pled guilty April 7, 2008 to second-degree murder, conspiracy to commit first-degree assault and use of a deadly weapon (knife) with intent to injure.  Under terms of the plea agreement Speake is to testify truthfully in this trial and will receive a prison term of 58-years suspend all but 43-years at a later date.
