2.2.11: Warner Convicted of First-Degree Murder, Robbery with a Deadly Weapon
February 2, 2011 -- A Baltimore City Circuit court jury convicted Marvin L. Warner today of six counts, including first-degree murder, for fatally shooting and robbing a victime in October 2009.
The victim was found in his vehicle with a gunshot wound to his head on October 13, 2009. Missing from the victim were various items, including money, a cell phone, and his keys. There were no eyewitnesses to the murder. Through the investigation the victim's keys were recovered, and a witness was able to identify Warner, 24, as being in possession of the keys after the murder.
A .38 caliber revolver was recovered from Warner's brother several months after the incident. During processing of the handgun, the vicitim's DNA was discovered in the barrel.
In addition to first-degree murder and robbery with a deadly weapon, Warner also was convicted of two counts of use of a handgun in the commission of a crime of violence, conspiracy to commit first-degree burglary, and possession of a handgun after being convicted of a disqualifying crime.
Warner is scheduled to go to trial on April 8, 2011, for a separate incident. He is charged with armed robbery and first-degree assault.
"We are pleased with the jury's verdict, which is consistent with our primary focus to remove repeat violent, repeat offenders from the streets," State's Attorney Gregg L. Bernstein said.
Scheduled for sentencing on March 18, 2011, Warner faces a maximum of life in prison plus 85 years.
