Statement Regarding Today's Developments in the Baltimore Police Laboratory

                PRESS RELEASE

Baltimore, MD August 20, 2008 -- Statement regarding today’s developments relative to the Baltimore Police Department’s Crime Laboratory (BPDCL):

Baltimore City State’s Attorney Patricia C. Jessamy confirmed today that on Friday, August 15, 2008 she received a telephone call from Police Commissioner Fred Bealefeld to alert her to a recently discovered contamination issue in the Baltimore Police Department Crime Laboratory. As a result of this notification Friday, State’s Attorney Jessamy asked several senior prosecutors, including the Chief of Forensics for the Baltimore State’s Attorney’s Office, to meet immediately that afternoon to review the findings by laboratory personnel.

As a result of the meeting Friday, prosecutors contacted representatives of the State Public Defender’s Office and the private bar in Baltimore to alert them of this development. It is unclear what the full scope of the contamination is upon open and closed cases processed at the DNA lab since 2001, however State’s Attorney Jessamy is working with the Baltimore Police Department to address the deficiencies and immediate remedies needed. Additional meetings will be held over the next several weeks as more information becomes available.

State’s Attorney Jessamy remains committed to working with Police Commissioner Bealefeld, and all other criminal justice partners affected by this development to resolve this matter as quickly and transparently as possible.
RAYMOND SAUNDERS PLEADS GUILTY TO ATTEMPTED FIRST-DEGREE MURDER AND USE OF A HANDGUN IN A CRIME OF VIOLENCE

Saunders sentenced to Life suspend all but 15-years . Held victim captive 11-hours before shooting him.

Baltimore, MD – August 7, 2008 – This morning Judge Robert Kershaw sentenced Raymond Saunders, 21, of the 2200 block of Sydney Avenue, to life suspend all but 15-years in prison with 3-years supervised probation for attempted first-degree murder and 5-years for the use of a handgun in a crime of violence after he plead guilty to the facts of the case. The sentences will run concurrently.

The elements of the offenses to which Saunders has plead guilty are as follows: On April 11, 2007 at 11:25 am in the 2400 block of Wilgrey Court, police officers found Michael Storm bleeding profusely after being shot in the chest and left arm. Mr. Storm reported that he had been operating as a “Hack” when he met Raymond Saunders to transport him to 2400 block of Wilgrey Court. After exiting the vehicle, and while Mr. Storm was waiting in his vehicle on another patron, Saunders returned to the vehicle to inquire about his cell phone believing he had left it in the car. When the phone was not found in the vehicle, Saunders became agitated with Storm. Storm entered the dwelling with Saunders in an effort to help him find the missing phone insisting to him that he did not have the phone. Saunders became more irate and held Mr. Storm captive at gunpoint. During the hours of captivity Saunders forced Storm to drive him around at gunpoint, accusing him of stealing the cell phone, threatening him and insisting the phone be returned. They returned to the 2400 block of Wilgrey Court when Saunder’s became irate and shot Michael Storm. Though Michael Storm suffered extensive internal injuries he was able to identify Raymond Saunders as the person who shot him after being held captive for 11-hours. Other witnesses present in the 2400 block of Wilgrey Court identified Saunders as the shooter. Raymond Saunders fled to New York and was arrested there by the Warrant Apprehension Task Force and the New York Police Department.

BALTIMORE JURY CONVICTS DERRICK COLLINS OF OF FIRST-DEGREE MURDER AND OPENLY CARRYING A DEADLY WEAPON

Sentencing scheduled for October 7, 2008.

Baltimore, MD – August 4, 2008 – Today a Baltimore City jury convicted Derrick Collins, 24, of the 300 block of S. Gilmore Street, of the first-degree murder of Annette Bardney and guilty of carrying a deadly weapon. The jury deliberated for two days following four days of testimony. Annette Bardney was 33-years old.

Judge Timothy Doory has scheduled sentencing for October 7, 2008. Collins faces a maximum possible sentence of life plus 3-years.

On December 18, 2006, Derrick Collins attempted to strangle Annette Bardney. When he failed to kill her, he picked up a wooden 2x4 and struck her in the head (nearly severing an ear) until she was dead. He left her body in a secluded back alley in the 700 block of Fremont Avenue behind a church. The defendant then called 911 and reported finding a dead body. After further investigation, it was learned that Collins’ DNA was left at the scene. In addition, his story about how he found the victim changed, and it did not fit the forensic evidence and he was charged with first-degree murder. While he was transported to Central Booking Intake Facility, Collins asked detectives in the case if they could broker a plea deal to manslaughter with the State.

Assistant State’s Attorney Kevin Wiggins of the Homicide Division prosecuted this case.
BALTIMORE JURY CONVICTS LARRY JOSEPH OF TWO COUNTS OF FIRST-DEGREE MURDER AND USE OF HANDGUN IN THE COMMISSION OF A CRIME OF VIOLENCE

Joseph Sentenced To Two Consecutive Life Sentences Plus 40-Years

Baltimore, MD – August 4, 2008 – Today a Baltimore City jury found Larry Joseph, 19, of the 900 block of N. Streeper Street guilty of two counts of first-degree murder and use of a handgun in the commission of a crime of violence. Joseph was convicted of killing Deion Morris and Channing Myrick on September 16, 2007. The Honorable Charles G. Bernstein sentenced Joseph to 2-life sentences plus 40-years, to run consecutively. The jury deliberated for 2-days following 4-days of testimony.

The facts of the case are that on the afternoon of September 16, 2007, near the 3400 block of BelAir Rd in Baltimore, Deion Morris and Channing Myrick were walking up the street when Larry Joseph approached. Larry Joseph drew a gun and shot Channing Myrick 5 times and Deion Morris 9 times. Both died as a result of multiple gun shot wounds. A pole camera that was located on the corner of Mayfield Avenue and Belair Road captured an unknown person approaching the victims and then fleeing the scene, however the footage was not able to positively identify Joseph as the shooter. The video did help prosecutors establish a timeline that was consistent with witness testimony and helped build a successful prosecution.
Assistant State’s Attorney Richard Gibson of the Homicide Division prosecuted this case.

ROZZA ALSTON SENTENCED TO TWENTY-THREE YEARS MAXIMUM POSSIBLE SENTENCE

Baltimore, MD – July 30, 2008 – Today Judge Timothy J. Doory sentenced Rozza Alston to 23-years in prison for the second-degree assault, armed robbery and openly carrying a dangerous weapon against an elderly woman.

In her impact statement, the victim advised the Court of the traumatic event saying “I was trying to be kind and helpful to a stranger and it turned into a nightmare. I am forever scarred by this...I was always an outgoing person and now I am scared...it is a miserable feeling to be scared.” Judge Doory referred to Alston as a “predator.” He condemned Alston for preying upon a vulnerable person.

The jury convicted Alston on the following facts. On January 26, 2007, Alston accosted an 80-year old woman in the parking lot of a Kentucky Fried Chicken located at 1821 Saint Paul Street demanding her purse. When the victim refused to release her purse, he stabbed her numerous times in her hand, arm and chest. Phone calls made with the victim’s cell phone to Alston’s residence led police to Rozza Alston. A search and seizure warrant recovered credit cards and other possessions of the purse at Alston’s residence. Police arrested Alston on February 3, 2007 and he confessed to the incident when he was taken into custody following the search warrant. A transcript of the confession was introduced as evidence. The State also introduced DNA evidence on clothing and gloves found in Rozza Alston’s apartment that linked clothes with the victim.
LANCE GORHAM SENTENCED TO 10 YEARS FOR VIOLATING PROBATION CONSECUTIVE TO 20-YEAR PRISON TERM

IN JUNE 2008 PROSECUTORS AND PROBATION AGENTS IDENTIFY VIOLATIONS

Baltimore, MD – July 29, 2008 – At a hearing Thursday, July 24, Judge Evelyn Omega Cannon found Lance Gorham, 26, of the100 block of Kenwood Avenue, guilty of violating his probation following a June 6, 2008 conviction for distribution of a controlled dangerous substance.

In November 2001 Gorham was convicted of attempted second-degree murder. At that time he was sentenced to 25 years with 20 years suspended and placed on three-years probation upon his release. While on probation in May 2006 he was arrested on a new charge of distribution of a controlled dangerous substance. He was convicted of that offense on June 6, 2008 and sentenced to 20-years by the Honorable John Prevas. The new conviction violated Lance Gorham’s probation. For violating his probation, Judge Cannon sentenced him to an additional 10-years consecutive to the narcotics case resulting in a total sentence of 30-years in prison.

Today’s hearing highlights the identification and prosecution of repeat offenders in Baltimore. This conviction is the result of a team effort by the Maryland Division of Parole & Probation and the State’s Attorney’s Collateral Division. The cases were prosecuted by Assistant State’s Attorneys Jerry Jones and Mark Floersheimer with the cooperation of Anthony Osian from the Department of Parole and Probation.
