8.25.11: Yeargin Sentenced to 10 Years for Probation Violation

August 25, 2011 -- Baltimore City District Court Judge Charles A. Chiapparelli sentenced Tony B. Yeargin on Monday to 10 years in prison for violating the terms of his probation. State's Attorney Gregg L. Bernstein highlighted the outcome as an example of what can be accomplished for the safety of the city when prosecutors collaborate effectively with police and the public and focus on probation violations.

Yeargin has had repeated contacts with the justice system, including one for alleged armed robbery and possession of a firearm, prompting residents of the city's southern district to express concern about him.

For a 2009 charge of attempt to distribute narcotics, Yeargin received probation before judgment. While serving that probation, he pled guilty in April 2011 to possessing a controlled dangerous substance in January 2011. Probationers are in violation when they fail to obey all laws.

Citing Yeargin's history and the community's concerns, Assistant State's Attorney Albert Peisinger Jr. requested that Judge Chiapparelli sentence the defendant to 10 of the 20 years possible.

"I want to thank the community residents and police officers who provided their support on this case. I also commend Assistant State's Attorney Peisinger for his aggressive and able handling of this violation hearing," State's Attorney Bernstein said. "This demonstrates our commitment to using every available tool to seek substantial terms of incarceration for offenders who prey on our city and citizens."

For separate narcotics-related charges, Yeargin, 21, is scheduled for trial on October 19, 2011.
